Local Manufacturers Advocate for Favorable Tax Regime

In the economic trajectory of Sierra Leone, it is important to note that the role of local manufacturing in sustaining a nation’s economy cannot be overstated.

It is an open secret that there are thriving local manufacturing companies currently being hampered in their operations because of unfavorable tax regimes

Although imports can be a vital source of goods and services, however, a balanced economic ecosystem necessitates the growth and sustainability of domestic manufacturing.

In order for the country to successfully achieve this, Government must implement tax regimes that favor these local manufacturers over importers of manufactured consumable goods and services.

The advantages of such a tax regime can obviously boost the economy if only it is structured well to promote local manufacturing. Worthy of note is that local manufacturing can form the backbone of a self-reliant and robust economy and when a nation manufactures its own consumable goods and services, it enjoys several benefits.

Manufacturing industries, like the Sierra Leone Brewery Limited and Bread Avenue, as cases in point, provide a significant source of employment as they create jobs for skilled and unskilled labor contributing to reduced unemployment rates.

Significantly, a thriving manufacturing sector leads to increased economic activity, driving GDP growth as it stimulates investments in technology, infrastructure, and innovation, which, in turn, results in a flourishing industrial base.

When local manufacturing is favoured, a country can decrease its dependence on imported goods, which often leads to trade imbalances and trade deficits and a more robust manufacturing sector can help in mitigating these imbalances.

Relying heavily on imports for essential goods makes a nation, like Sierra Leone, vulnerable in times of crisis. Local manufacturing enhances a country’s self-sufficiency and national security.

Local manufacturers are more likely to invest in research and development, driving technological advancements. This innovation can also foster knowledge transfer and the development of a skilled workforce.

It is important for the Government to note, especially in these crucial economic times that a tax regime that prioritizes local manufacturing over imports offers several advantages to the economy. One of the most significant benefits is the reduction of dependence on imported goods. When local manufacturers are favored, consumers have access to domestically produced alternatives, reducing the need for foreign products.

Local manufacturers, like SLBL and Bread Avenue, are more likely to invest in expanding and improving their production facilities when they receive tax incentives. This capital injection drives economic growth and creates a ripple effect in the form of increased demand for raw materials and services.

As mentioned earlier, local manufacturing generates jobs across various sectors. When manufacturers expand, more job opportunities are created, leading to reduced unemployment and improved living standards for the workforce.

The Ministry of Finance and the National Revenue Authority must realize that a tax regime that encourages local manufacturing can promote the adoption of advanced technologies and automation, enhancing the skillset of the local workforce which, in turn, leads to a more competitive and productive manufacturing sector.

Members of Parliament, who must be at the vanguard to advocate for favourable tax regimes for local manufactures must note that a thriving local manufacturing industry can lead to surplus production, which can be exported to international markets. Furthermore, they must take cognizance of the fact that as the quality and competitiveness of locally manufactured goods and services improve, they can become valuable exports, thereby bolstering the nation’s international trade position.

The fact must be realized that designing a tax regime that supports local manufacturers while being fair and sustainable requires careful planning and implementation.

Tax incentives must be provided such as reduced corporate income tax rates, investment tax credits, and accelerated depreciation for manufacturers. This lowers their overall tax burden, making it more attractive to invest in local production.

Adjustment should be made on customs and import duties to favor domestic goods and such can make imported products more expensive compared to locally manufactured ones, thereby stimulating domestic consumption.

Offering tax credits to companies investing in research and development can be motivating. This can spur innovation, leading to the development of new products and technologies that enhance the competitiveness of domestic manufacturers.

A well-structured tax regime that favors local manufacturers over importers of consumable goods and services can have a profound impact on an economy. It leads to job creation, economic growth, and a reduced reliance on imports, thereby promoting self-reliance and national security. Furthermore, such a tax regime can stimulate investments, technology transfer, and innovation, making the domestic manufacturing sector more competitive on a global scale.

Pastor Mambu’s Rice Farm Emerges as a Model for “Feed Salone”

In a remarkable achievement, the Faith Healing Agricultural Development Organization (F.H.D.O) rice harvest this year at Mambu’s Rice Farm has garnered widespread acclaim as a model for agricultural productivity and self sufficiency in Sierra Leone, under the Government’s flagship programme better known as the “Feed Salone” initiative.  The astonishing success of the FHDO’s agricultural project has not only transformed the local farming landscape but also positively impacted the lives of numerous individuals in the region.

Located in Royanka Village, the Mambu’s Rice Farm spans an impressive 106 acres out of a total 306 acres allocated for rice cultivation this year. Additionally, the farm dedicated 60 acres to corn, 14 acres to groundnut, and houses approximately 5,000 chickens at Yainkasa village. This agricultural endeavor has led to significant employment opportunities for residents in neighboring villages, with seven women’s farmer groups being the primary beneficiaries. Moreover, the farm has implemented a microcredit scheme that extends financial support to six villages, namely the Gbomsamba, Royeama, Woreh Yeama, Yainkassa, Royanka, and Maronkoh villages in northern Sierra Leone.

In a Press Statement, Pastor Francis A. M. Mambu, the Director of F.H.D.O and a respected preacher-farmer hailing from Kailahun District, attributed the farm’s extraordinary success to the significance of timing in agriculture. He expressed immense fulfillment and viewed this endeavor as an opportunity to serve his country. Pastor Mambu’s dream is to see F.H.D.O expand its reach to every district and chiefdom in Sierra Leone, ultimately improving the lives of the less fortunate.

This thriving farm, brimming with growth prospects, is involved in processing and marketing locally produced rice, vegetables, and poultry. It also provides invaluable support to local farmers and over 500 households. Notably, the farm has ventured into mushroom farming for both local and international markets. To further their noble mission of uplifting local communities from poverty and ensuring food security, Mambu’s Rice Farm is appealing for support from the Government of Sierra Leone and other key stakeholders.

Pa Mambu, a food security Ambassador, emphasized the financial and machinery challenges facing the farm project while expressing gratitude for the support received from the Ken Royal Foundation and other well-wishers.

The District Agriculture office of the Ministry of Agriculture was present at the rice harvest launch, and Jane Fea Kabba-Sei, a representative, commended the farm’s outstanding quality and quantity of produce. She encouraged Pastor Mambu to persist in this endeavor as a means of achieving self-sufficiency in Sierra Leone.

Speaking on behalf of the Ken Royal Foundation, one of the organizations supporting the farm, Jeff Fisher expressed his contentment with the farm’s remarkable harvest this year and pledged ongoing support for Pastor Mambu’s inspirational initiative.

The Mambu’s Rice Farm stands as a testament to the power of dedication and determination. Beginning as a grassroots project with minimal external support, it has now earned its place as a model for sustainable agriculture and community development in Sierra Leone.

Standard Chartered Bank Ex-Employees Protest for End of Service Benefits

Standard Chartered Bank former employees on Thursday, 12th October, 2023 staged a protest before the bank headquarters demanding their terminal benefits.

Fifty-One (51) former employees of Standard Chartered Bank are seeking compensation and benefits following the termination of their employment contracts in a case titled: “Felix Berethe & 51 Others vs. Standard Chartered Bank Sierra Leone Limited”.

During a former legal proceeding, on October 6th, 2023, the High Court of Sierra Leone, presided over by Justice Hannah Bonnie, ordered the bank to make a payment of NLE 124,018,730.55, equivalent to $5,536,550.47 to the affected former employees within a seven-day timeframe.

However, in a new twist, Standard Chartered Bank is seeking before, Justice Jamesina King, of the Industrial and Social Security Division of the High Court of Sierra Leone leave to appeal the said order in the matter which was adjourned to Wednesday 18th October for further hearing.

Justice Jamesina King is now dealing with the consequential legal battle which is at the crossroads of labour rights and banking regulations.

This contentious case arose from the Employment Act No. 15 of 2023 and Convention 095 – Protection of Wages Convention, 1949 and has captured the attention of legal and financial experts nationwide.

The former bank employees are represented by the legal team at Lambert & Partners in the High Court in Sierra Leone through an application filed on October 11, 2023.

The case, which is framed within the framework of the Employment Act No. 15 of 2023 and Convention 095 – Protection of Wages Convention, 1949 (No. 95)  also invokes the International Covenant on Economic, Social, and Cultural Rights and is grounded in Order 5 Rule 4 of the High Court Rules 2007, Constitutional Instrument No. 8 of 2007.

It must be reiterated that the High Court’s October 6, 2023 decision ordered Standard Chartered Bank Sierra Leone Limited to disburse a significant sum of Le124, 018,730.55, equivalent to USD5, 536,550.47, alongside an additional 10% of that amount.

The funds were mandated to be held in an escrow account at the Sierra Leone Commercial Bank Limited, with disbursement subject to the court’s further approval. The approval is to be determined before the bank’s sale, divestiture processes or the recognition of new owners by the Central Bank of Sierra Leone or any other regulatory body.

However, an instruction was given to legal representatives to pursue leave to appeal the decision at the Court of Appeal and aims to address several critical concerns.

Firstly, the plaintiffs argue that the court’s decision prematurely presumes their right to redundancy compensation and end-of-service benefits without due consideration of relevant contractual agreements, legal provisions, collective agreements, or statutes. They contend that the decision could set a precedent, allowing courts to unilaterally define the terms of employment contracts for supervisory-level bank employees, potentially impacting the broader banking industry in Sierra Leone.

Moreover, it is believed that the sums ordered for the escrow account are excessive, unreasonable and lacking a contractual, legal or statutory foundation. They argue that these funds could be disbursed without a stay of execution, presenting a significant risk of irretrievable loss.

This impending legal battle is anticipated not only to address the concerns of the 51 former employees but also to set a momentous legal precedent that could reshape employment contracts and compensation within the Sierra Leonean banking sector.

The Defendants (Standard Chartered Bank) have appealed the ruling and are steadfast in their stance, asserting that their appeal has strong prospects of success, and that this legal challenge represents a landmark case with far-reaching implications for Sierra Leone’s labor landscape.
The defendant/applicant (Standard Chartered Bank) is now petitioning for a stay of execution of this order while concurrently seeking permission to appeal the ruling to the Court of Appeal. They contend that the court’s decision constitutes a premature judgment on compensation and benefits issues, lacks support in any contracts or statutes, and could establish a precedent affecting employment agreements across the banking sector.

The defendant/applicant (Standard Charted Bank) has also expressed concerns that without a stay of execution, the funds held in the escrow account may be released to the plaintiffs/respondents, potentially rendering the bank unable to recover these amounts if their appeal proves successful.

Ransford Johnson, a Barrister and Solicitor representing the defendant/applicant, has submitted an affidavit in support of the notice of motion, emphasizing the strong likelihood of success for their appeal in the Court of Appeal.

Nonetheless, the former Standard Chartered Bank Sierra Leone employees remain resolute in their pursuit of justice and have brought their grievances to the highest court in the land, invoking various legal instruments and regulations to present their case.

This case underscores the importance of legal safeguards for both employees and employers in the country and highlights the need for meticulous examination of employment termination and compensation matters, especially within the banking industry.

Chief Justice Receives EU Report on June Elections

The Chief Justice, His Lordship Justice Desmond Babatunde Edwards on Friday October 13, 2023, received the final report from the European Union Electoral Observation Mission to Sierra Leone (EU-EOM) on the June 23 General Elections in a formal ceremony held in the Chief Justice’s Conference Room.

The EU-EOM delegation, led by the EU Ambassador to Sierra Leone, H. E. Manuel Muller, presented a copy of their report to the Honourable Chief Justice and the Judiciary of Sierra Leone. Ms. Evin Incir, the Chief Electoral Observer of the EU-EOM and a member of the European Parliament, expressed that the report encapsulates the observations of 104 long and short-term observers who meticulously covered the entire electoral cycle.

The report, she explained, contains 21 recommendations that revolve around the principles of transparency, inclusion, and accountability. These recommendations were drawn from the EU-EOM’s work, which spanned from the pre-electoral period to activities during and after the elections, including the tabulation and analysis processes.

Ms. Incir emphasized the honor of serving as the Chief Observer and highlighted the enduring partnership between the European Union and Sierra Leone, which has grown over the years.

Legal Analyst, Sylvian Ollier, discussed the recommendations further, with a particular focus on the need to cleanse the legal framework regarding elections. Additionally, he emphasized the importance of expeditious adjudication of pre-election cases, particularly those related to Presidential Candidates and their challenges. Ollier also underscored the necessity of prompt results handling in the event of a runoff.

In his welcoming remarks, Chief Justice Desmond Babatunde Edwards noted that the recommendations provided are general in nature and do not specifically pertain to the Judiciary due to the absence of election petitions before the Court—either before, during or after the elections. He assured that the recommendations would be carefully examined and addressed where necessary.

The Chief Justice took the opportunity to express his gratitude to the European Union for their unwavering support to the Judiciary through the United Nations Development Program (UNDP). He cited the numerous initiatives undertaken, including the organization of four separate training sessions for Judges on electoral laws, the development of an improved compendium on electoral laws and a revised curriculum.

H. E. Manuel Muller, the EU Ambassador, reaffirmed the European Union’s commitment to supporting the Judiciary of Sierra Leone in areas that have been identified for assistance.

Eight Suspects in Custody for Attempted Sacrilege & Arson at Local Church

In a recent legal development, eight individuals, identified as Alpha Bangura, Patheh Jalloh, Dauda Jalloh, Santigie Koroma and four others found themselves in the spotlight as they made their first court appearance before Magistrate Mark Ngegba at Court No1 on Pademba Road in Freetown. They were facing allegations of breaking into the Gateway Evangelistic Ministry Church and stealing items valued at over one hundred thousand Leones.

The accused were charged with a total of seven counts, encompassing a range of offenses. These include conspiracy, sacrilege, attempted arson, malicious damage, throwing missiles, riotous conduct, and disorderly behavior, all of which contravene various sections of the law.

According to the specifics of the charges, on the 24th of September 2023, Alpha Bangura, Patheh Jalloh, Dauda Jalloh, Santigie Koroma, and the four others allegedly conspired to commit a crime at the Gateway Evangelistic Ministry Church in Quarry Kissy, Freetown.

The second charge alleges that on the same date and at the same location, all accused persons unlawfully entered the Gateway Evangelistic Ministry Church and stole items including a Lenovo laptop computer, a computer laptop, an iPhone 13 Pro Max, an Ultra Samsung mobile phone, and ten yards of carpet, totaling one hundred and twenty-seven thousand two hundred Leones (Le127,200/00). These items were the property of the church.

The third charge accuses Alpha Bangura of attempting to set fire to the Gateway Evangelistic Ministry Church on the same date and at the same place.

The fourth charge claims that Patheh Jalloh and the eighth accused person maliciously damaged 58 pieces of window glasses and their frames, three plasma televisions, two HPIS computers, and other valuable items, all with a total value of three hundred and twenty-seven thousand new Leones. These items also belonged to the Gateway Evangelistic Ministry Church.

The fifth charge states that the accused parties, excluding Alpha Bangura, were found throwing missiles at the Gateway Evangelistic Ministry Church on the same date and at the same location.

The sixth charge alleges that the accused parties engaged in riotous conduct at the same date and place.

The seventh charge asserts that all the accused individuals behaved in a disorderly manner on the same date and at the same location.

During the court proceedings, the accused were represented by Julian Cole, Esq., who applied for bail. However, the Prosecutor objected to bail, citing concerns that some of the accused do not have fixed addresses and might jump bail.

Following arguments from both sides, the Magistrate noted that if most of the accused do not have permanent addresses, the Police should not have granted them bail in the first place. In light of this, bail was granted to Alimamy Koroma and Mohamed Conteh, both students, under special conditions. They were required to pay one hundred and fifty thousand Leones each and provide one surety. These sureties must be gainfully employed and surrender their voter or national ID cards.

For the remaining accused individuals, bail was granted at one hundred and fifty thousand Leones each and they were also required to provide two sureties each, who must be gainfully employed.

Failing to meet these conditions, the accused persons were taken into custody and are scheduled for a court appearance on the 20th of October 2023. The prosecution of the matter is being handled by ASP Ibrahim Mansaray.

International Day of the Girl Child: A Reflection on Celebration and Commemoration

In the global observance of the International Day of the Girl Child, the world stands divided between celebration and commemoration. This day, established in 2012, serves as a beacon of recognition for the fundamental rights of girls and the challenges they face worldwide. While some nations enthusiastically celebrate, others take a more solemn approach, choosing to commemorate the struggles and triumphs of girls. In the case of Sierra Leone, a reflection on its journey reveals a lingering uncertainty about the nature of the observance.

The International Day of the Girl Child was created by Plan International, a global organization dedicated to improving the lives of girls, especially in developing nations, through their, “Because I Am a Girl” campaign. The United Nations formally proposed this day as a resolution in 2011, sponsored by Rona Ambrose, Canada’s Minister for the Status of Women.

On December 19, 2011, the United Nations General Assembly passed Resolution 66/170, officially designating October 11, 2012, as the very first International Day of Girls. This historic resolution emphasizes the incredible strength and potential of girls, their transformative impact on economic prosperity and the importance of empowering them.

Despite Sierra Leone’s annual observance of the International Day of the Girl Child, its girls continue to face unprecedented challenges. These include sexual abuse, teenage pregnancy, child marriage, limited access to education, gender-based violence, unfair discrimination, exploitative child labor, high school dropout rates and maternal mortality.

While the International Day of the Girl Child raises awareness about the challenges faced by girls worldwide, numerous obstacles still impede their growth and development. It is a collective responsibility to overcome those challenges and create a world where girls can thrive and be empowered.

Recent research in Sierra Leone reveals alarming statistics related to teenage pregnancy and maternal health. The country ranks among the top ten nations with the highest rates of teenage pregnancy globally. Adolescent fertility rates remain high and maternal mortality disproportionately affects teenage girls, with an estimated 40% of maternal deaths occurring in this age group. While the recognition of International Girls’ Day is significant it serves as a reminder that much work remains.

Addressing these challenges requires more than mere words; it necessitates action. Sierra Leone and the global community must prioritize girls’ empowerment, the realization of their rights, and the creation of a nurturing environment for their growth and success. This can be achieved by incorporating sexual and reproductive health education into teenagers’ lives, providing opportunities for redemption to victims of teenage pregnancy, offering more educational resources and scholarships for girls, accelerating justice for survivors of sexual and gender-based violence, upholding gender laws, strengthening healthcare systems, and fostering mentorship for girls.

As UN Secretary-General, António Guterres, aptly noted, women and girls possess remarkable leadership abilities. They have the potential to transform attitudes, ignite positive change and drive the development of policies that cater to their unique needs. With their invaluable leadership, women and girls can guide the world toward a future that is fair and equitable for all. The International Day of the Girl Child serves as a poignant reminder that the world must work collectively to turn this vision into a reality.

Sierra Leone Budget Hearing: Chief Fire Officer Highlights Force Constraints

The Chief Fire Officer of the National Fire Force (NFF), Nazir Kamanda Bongay, has detailed the substantial challenges faced by the National Fire Force in executing its mission of preventing and managing fire accidents within the country. This revelation came during the 2024 Budget hearing, which took place on October 11, 2023, in the Conference Room of the Ministry of Finance in Freetown.

Bongay emphasized that the force is grappling with inadequate budgetary allocations for its critical operations, hindering its capacity to function as a vital public safety establishment. Moreover, insufficient funding for emergency activities, including the immediate repair of fire engines, significantly hampers the department’s operational effectiveness.

He pointed out that the scale of  fire and burn issues in Sierra Leone is substantial, annually resulting in fatalities, injuries, the displacement of hundreds of people, and multimillion-dollar losses in terms of human lives, property and business. This collective impact represents an economic burden of approximately 1 to 2% of the country’s GDP.

Bongay cited informal construction and settlements as particularly challenging issues, as they are more susceptible to rapid fire growth and spreading. Such areas, like Kroo Bay and Susan’s Bay, often lead to the displacement of numerous residents, even when casualties are minimal.

The Chief Fire Officer provided an overview of the current state of the Force revealing that it comprises only 427 dedicated staff who work in demanding conditions with limited resources and equipment. He stressed that the Force faces a severe shortage of firefighters, personnel, engines, equipment, and firefighting chemicals, hindering their ability to respond effectively to fire incidents across the nation.

Bongay stated, “The available equipment for firefighting, search and rescue operations falls short of what is required to efficiently carry out our mission of saving lives and protecting properties threatened by fire incidents.”

He underscored the daunting national task that the Force confronts—responding to emergencies with a severely restricted capacity.

Amadu Wurie Sowe, an LGBTQ advocate in hiding, as Sierra Leone police launches anti-gay crackdown

In a press release issued by the Sierra Leone police in October 2023 announcing the arrest of an LGBTQ advocate, Amadu Wurie Sowe of Kassirie Community, Samu Chiefdom, Kambia District for practicing gay have attracted many citizens going in search of Amadu, as majority of Sierra Leoneans are against the crime.

According to a resident of Kambia District, who identified himself as Foday and a friend of Amadu, the latter had been very secretive about his sexual orientation since they were early teenagers until Amadu was caught having anal sex with his male partner called Samuel on Tuesday 10th October, 2023 by his father, who is part of religious leaders in the district, at their residence around Kassirie, Samu Chiefdom, Kambia District.

Whiles narrating to the press, Foday noted that Amadu’s father who could not bear the shock of what he had seen decided to alert Amadu’s mom and stepmother as he shouted in apparent defiance and disgust. He adding that it was a battle between Amadu’s family and the Islamic Leaders in the Community in Kambia for Amadu to be killed by stoning him to death or beating him to death as it is against Islamic beliefs. They were on this argument when the Kambia Police came and arrested Amadu for committing an offence against the Person Act 1861 Section 61” which says Male same-sex sexual activity whether in public or private is illegal and it’s imprisonment for life; Amadu was then detained for his alleged sexual offence.

‘’Few days in police cell the community people came to know that Amadu has then fled the residence to seek refuge in another country’’ says Foday. According to eye witness, a Catholic Philanthropist identified as Reverend Christopher (Rev. Chris) is reported to have rescued Amadu by providing funds to flee the country in order to save his life having learnt of the numerous physical attacks on persons practicing and engaging same-sex sexual activity in the country. Foday further explained that after several threats to Amadu’s life from unknown persons who feel strongly about gays in the community, as their sexual orientation is believed to cross the boundaries of tradition and societal decency.

To compound Amadu’s situation Foday went on revealing that Amadu’s father has disowned him for what they said is bringing the name of the family to disrepute. Media Investigation prove that during a door-to-door headhunt for Amadu, youth and angry community members ransacked Amadu’s house both in the village and in Freetown and that of his Mother’s place, leaving all his belongings and those of his mother’s property all stolen.

Like Amadu, many have been lucky to escape to other countries while others have been unlucky to fall in the net of group of people who have taken as a pastime to physically attack and harm persons indulged in same sex. To date, the whereabouts of Amadu reportedly remains unknown since his father exposed him some days ago.
