Inspector-General of Police & Law Officers’ Department at Loggerhead

The Law Officers’ Department of the Office of the Attorney-General and Minister of Justice has formally requested evidence from the Sierra Leone Police Inspector-General after disparaging remarks surfaced on social media.

In a video that circulated online, the Inspector-General was heard making condescending comments towards lawyers within the Law Officers’ Department, referring to them as “Small Small infant lawyers” who “can be compromised.” Furthermore, he accused the Director of Public Prosecutions (DPP) of not personally reviewing files from the Police but instead delegating them to junior lawyers.

The Director of Public Prosecutions, Osman I. Kanu, expressed “strongest dismay and disappointment” in a letter addressed to the Inspector-General. The Law Officers’ Department has condemned these statements as “unprofessional, offensive, and demeaning,” emphasizing that such utterances are unacceptable from someone in charge of the country’s internal security.

The letter insists that public statements, especially concerning public officials or institutions, ought to be factual and verified before being made public. In response to the gravity of the accusations, the Law Officers’ Department has requested the Inspector-General to provide specific details supporting his claims:

1. Names of the lawyers alleged to be susceptible to corruption.
2. Files reportedly ignored by the DPP.
3. A record of drug-related cases forwarded to the Law Office since the beginning of the year.

The request for this information comes with a deadline, urging a response by the 25th of March, 2024. The situation has caught the attention of various stakeholders, including the Hon. Speaker of Parliament, the Attorney-General and Minister of Justice and others, all of whom were copied in the letter seeking clarification and evidence from the Inspector-General.

The incident has sparked a broader discussion on the integrity and professionalism within Sierra Leone’s justice system, highlighting the need for respectful collaboration between different branches of law enforcement and the legal community.

The Law Officers’ Department awaits the Inspector-General’s response, with the expectation that it will shed light on the accusations and contribute to upholding the esteem of Sierra Leone’s legal institutions.

Freetown to Host Inaugural ECOWAS Summit on Autonomous Weapons Security

In preparation for the forthcoming Regional Conference on the Peace and Security Aspect of Autonomous Weapons System: An ECOWAS Perspective, slated to be held in Freetown, Sierra Leone from April 17 to 18, 2024, the Embassy and Permanent Mission of Sierra Leone in Geneva, Switzerland convened a crucial meeting on Thursday, April 4, 2024. The gathering welcomed Ambassadors from ECOWAS Missions and Embassies based in Geneva.

The consultative session held in Geneva aimed to brief member states about the impending Regional Conference on the Peace and Security Aspect of Autonomous Weapons System: An ECOWAS Perspective. Among the key issues discussed, Dr. Lansana Gberie, the Head of Mission, Ambassador, and Permanent Representative of Sierra Leone in Geneva, Switzerland, highlighted the pressing concerns surrounding the integration of autonomous technologies in weapon systems. He emphasized that Autonomous Weapons Systems (AWS) pose significant threats to global peace and security, with their potential replication and transfer raising alarming issues. Dr. Gberie stressed the importance of addressing this challenge urgently, leading to the organization of the high-level Regional Conference in Freetown.

His Excellency Lansana Gberie, Ambassador and Permanent Representative of Sierra Leone to the United Nations and other International Organizations in Geneva, shared insights into Sierra Leone’s perspective regarding the upcoming Regional Conference. He underscored President Bio’s commitment to regional peace and security as pivotal for driving sustainable development, emphasizing investments in Human Capital Development among other priorities.

Addressing the gathering, H.E. Mr. Christian Guillermet Fernandez, Ambassador and Permanent Representative of Costa Rica, expressed gratitude to the government of Sierra Leone for hosting the significant Regional Conference. He highlighted Costa Rica’s previous efforts in addressing the challenges posed by autonomous weapons systems, showcasing the relevance of regional cooperation in governance and regulation.

Ambassador Gberie reiterated the urgent need to address the threats posed by autonomous weapons systems within the regional and global security landscape. He emphasized Sierra Leone’s dedication to engaging constructively in discussions for a new legally binding instrument aimed at ensuring meaningful human control over such systems.

The first Regional Conference on the Peace and Security Aspect of Autonomous Weapons System: An ECOWAS Perspective, scheduled for April 17-18, 2024, is expected to culminate in a consensus-driven outcome document. This document will reflect the collective commitment of ECOWAS member states to tackle the challenges posed by autonomous weapons systems, advancing collaborative efforts towards peace, security, and humanitarian values within the ECOWAS region and beyond.

Milla Group, Real Value Foods SL Commission 6 Compartment Toilet Building at Grafton Community

During a snap but a very impressive event convened on the 3rd April, 2024 by Milla Group and Real Value Foods SL Ltd within the Grafton Community, in the Western Rural District, a six compartment standard toilet facility was commissioned, mainly geared towards improving sanitation for the community residents.

Key residents of the Grafton Community that were present included  Councilors,  Mohammed Lamin Kamara and  Alusine, the Headman -Harrray Bangura , the Community Chairman – Foday Fofanah, the Chairlady- Ejiatu Sesay , the Section Chief -Pa Kabia, the Youth Leader – Ibrahim Albert Gandi, Madam Isatu Bah, David Fofanah and Kadie Nabieu.

Present on the part of the companies were Lamin Koroma and Mr. Ghandi with Rajesh Hemnani unavoidably joining the gathering during the tail-end of the programme.

In his statement, during the occasion, the Environmental Lead Consultant of ECOSYS SL Limited, Anthony Toban Davies, who also doubles as an official of Real Value Foods, a component of Milla Group, that is engaged in the manufacturing of sausages, intimated that the programme was geared towards the implementation of a compliance obligation by the two companies in terms of facilitating development under their Corporate Social Responsibility. He said the environmental laws of the country mandate them to fulfill such an obligation within the Grafton Community as it is one of their operational locations saying they had been doing so in past years.

According to him they have assisted the Grafton Community with sustainable toilet facilities for the past three years now revealing how in 2017, through their collaborative efforts, that is Milla Group and Real Value Foods, they pulled financial resources together, constructed and commissioned a four room toilet facility built within the Grafton Market.

He continued by informing that such was replicated in 2023 with the commissioning of a six compartment toilet facility saying the programme which has again brought them together is to witness the handing over of another standard six compartment toilet facility stressing that all the facilities that they have offered the community are constructed to be very sustainable.

Anthony Toban Davies, also pointed out that both Milla Group and Real Value Foods want to assure the Government that, as good corporate citizens, they will continue to comply with statutory obligations that mandate them to give back to communities where they operate. He praised the residents of Grafton for their hospitality and wishing that the existing relationship that exists among them will continue to blossom as well as expressing optimism for the improvement of the economy so that they will continue to do more for the community.

He ended by maintaining that they are committed to set examples that will serve as pointers which other industries operating within the Grafton Community will emulate underscoring how it is important to implement sustainable projects that will positively impact the beneficiaries and even benefit generations yet unborn.

On behalf of the community residents, the Headman of Grafton ,Harrray Bangura, expressed profound thanks and gratitude to Milla Group and Real Value Foods for the gesture describing it as not only timely but very significant in improving sanitation within the Grafton Community. He praised the two companies for the respect that they have been showing to the community residents and also promised that they will make good use of the toilet facility.

Africell Partners with other Organizations to Honour World Autism Day

In a heartening collaboration, the Kissy Psychiatrist Teaching Hospital, alongside Africell, Nania Educational Group, Sahid Autism, and World Hope Organization, came together to observe World Autism Day with a special event. Held at the Africell Sport Center in Aberdeen, Freetown, the occasion drew families, volunteers, and advocates from all corners of Sierra Leone.

Dr. Elizabeth Alieu, a distinguished psychiatrist from The Kissy Psychiatrist Teaching Hospital, underscored the significance of the day, emphasizing its role in raising awareness and fostering acceptance for individuals with autism in Sierra Leone. Government Must Endeavour to Protect the Country’s Tax Regime

Skewed reports have been unjustly insinuating that Leonoil Company is flouting court orders, painting a misleading picture of the company’s compliance with legal obligations. These assertions are not only baseless but also maliciously twisted, aiming to tarnish Leonoil’s reputation. Contrary to these claims, Leonoil has upheld legal standards and vehemently denied any wrongdoing in its dealings with SKM Enterprise’s CEO, Jaffer Zeghir.

The genesis of this controversy traces back to an allegation of tax evasion related to a fuel purchase transaction between Leonoil and Jaffer Zeghir. In this transaction, Jaffer procured 430,000 liters of fuel from Leonoil but only collected 230,000 liters, leaving behind a substantial portion of 200,000 liters. Despite repeated requests from Leonoil, Jaffer adamantly refused to collect the remaining fuel, leading to a price difference owing to Government-mandated price adjustments.

It is crucial to note that this price difference is not profit for Leonoil but rather constitutes tax payable to the Government of Sierra Leone through the National Revenue Authority (NRA).

Instead of resolving the matter in adherence to standard industry practices, Jaffer chose to pursue legal action against Leonoil. Regrettably, the court ruled in Jaffer’s favor, seemingly overlooking the broader implications of their decision on tax laws, effectively condoning a form of tax evasion.

In response to this ruling, Leonoil promptly filed an appeal, emphasizing its standard operating procedure that mandates buyers to cover price differences resulting from Government-imposed adjustments. This protocol is universally applied, extending even to Governmental entities, including State House and Foreign Embassies.

As a matter of fact it is imperative for the public to know that the notion propagated against Leonoil that it is willfully flouting court orders is totally incorrect and misleading. The reality is that an appeal is currently pending and the Appeals Court has yet to commence adjudication on the matter.

Leonoil reiterates its steadfast commitment to compliance with legal obligations, including fulfilling its tax liabilities to the Government without any form of discrimination.

It has also been alleged that Jaffer Zeghir has been making disparaging remarks against some Government officials, including the Ministers of Finance, Trade and the Financial Secretary, often posted on social media and published.

His persistent behaviour of dodging payment of  tax raises the question about whether he has an ulterior motive and could be undermining the efforts of the Sierra Leone Government if not brought to book.

To crown it all it is essential for a separation of fact from fiction and to gain a comprehensive understanding of the true events underlying the dispute between Leonoil and Jaffer Zeghir.

And it must be noted that despite the unwarranted bashing by certain outlets, Leonoil remains unwavering in its dedication to legal compliance and fair business practices.

Leonoil is calling on the Judiciary, the NRA and other relevant stakeholders to do all within their ambit to uphold and protect the country’s tax regime.

Higher Taxes Undermine Economic Growth & Fuel Rampant Smuggling

The imposition of higher taxes unquestionably exerts a direct influence on a country’s economy and can significantly fuel the rampant smuggling of essential goods. This concern becomes even more pronounced in Sierra Leone, where the majority of consumed products are imported, underscoring the critical role of importers in the nation’s economic landscape.

While there is a concerted effort towards nurturing local industries to foster growth and sustainability, it is also essential not to overlook the indispensable contribution of importers. They stand as vital cogs in the economic machinery, playing a pivotal role in revenue generation, consumer choice and employment opportunities, thus warranting recognition and protection of their interests.

At the heart of the argument lies the substantial revenue generated through import duties and taxes, serving as a vital source of funding for essential public services, infrastructure projects and social welfare programs. However, it is imperative to strike a delicate balance between taxation and maintaining the import sector’s vibrancy. Excessive taxation or regulatory burdens can stifle importer activity, leading to diminished revenue streams for the Government.

Moreover, consumer choice is a fundamental aspect of any free-market economy. Allowing consumers the freedom to choose from a diverse range of products, whether domestically produced or imported, fosters innovation, enhances product quality and promotes competitive pricing. Restricting importers or monopolizing certain goods undermines this principle, curtailing consumer options and impeding market competitiveness.

Another critical concern stemming from onerous taxation is the proliferation of illicit activities like smuggling. When import duties become prohibitive, it creates fertile ground for the underground economy, siphoning revenue away from the Government and distorting market dynamics. Combating illicit trade requires fostering an environment conducive to legitimate import activities, thereby safeguarding the integrity of revenue collection mechanisms and market regulations.

Beyond financial considerations, importers play a pivotal role in employment generation and economic vitality. From small-scale enterprises to large corporations, the import sector spans a diverse spectrum of businesses, providing livelihoods for countless Sierra Leoneans across various skill levels and sectors. By sustaining a vast network of employment opportunities in logistics, distribution, and retail, importers contribute significantly to economic growth and social stability.

Given the multifaceted importance of importers, policymakers must prioritize their protection and support. This necessitates a comprehensive approach that balances revenue generation, consumer empowerment and economic development. Policy measures may include rationalizing import tariffs, streamlining regulatory processes, and fostering collaboration between public and private stakeholders to create an enabling environment for importers to thrive.

Importers represent the lifeblood of Sierra Leone’s economy, embodying the principles of entrepreneurship, innovation and inclusivity. Their contributions extend beyond mere commercial transactions, encompassing vital aspects of revenue generation, consumer empowerment and job creation. It is an irrevocable fact that NP-SL Ltd continues to optimize Customer Care on a high pedestal everywhere the company has a presence. In no way can it be disputed that NP- Sierra Leone Limited (NP-SL Ltd) is currently the leading petroleum marketing entity in the country. Indisputably, a striking attribute  that the company has thoroughly harnessed to the fullest is a no nonsense stance in enhancing customer care as the Shareholders and Management of the company take it seriously and are doing everything within their ambit to enhance such with a view of giving maximum satisfaction to its numerous and cherished customers.

This method of conducting cashless transaction is very advantageous in the sense that a customer is saved the hassle of intermittently rushing to the bank to withdraw cash for the sole purpose of purchasing fuel. This is so because already his or her NP Smart Card is loaded with money for that purpose. Indeed, it also provides security as the card is securitized only having the particulars of the holder which cannot be used by another person.

Human beings cannot exist in the absence of food as it is a basic necessity of life. Food is prepared in various ways but one popular way of doing so is by cooking. In this part of the world, most households are dependent on largely using wood and charcoal for cooking purposes. However, the cutting down of trees to be used as wood and charcoal have been frowned upon by environmentalists on the grounds that such is contributing negatively  to the depletion of the environment and pose other adverse consequences on the ecosystem.

Go and Grab Your ID Card as Deadline Shifted to 28th June 2024

An extension of the deadline, to the 28th June 2024, for obtaining national identity cards, including National, ECOWAS, and Non-National cards was recently announced by the Government of Sierra Leone through the National Civil Registration Authority (NCRA). The notification was made known through a public notice dated 28th March 2024.

The rationale for the extension hinges on the Government’s commitment to ensuring that citizens have adequate time to obtain their identity cards. It is a move that aligns with a Cabinet Directive ratified by Parliament in March 2022, mandating the linkage of ID Cards with the National Identification Number (NIN) embedded in the cards. This embedment streamlines access to a range of essential services, including financial transactions, vehicle registration, enrollment in public and private institutions, NASSIT enrollment, land and property registration, educational enrollment, SIM card registration, immigration services, business registration, and the registration of vital events.

The public notice encourages individuals to obtain their identification cards from any NCRA office or designated center across the country within the operating hours of 8:30 am to 5:30 pm, Monday to Friday, by the new deadline of 28th June 2024. It underscores that while National and Non-National identity cards are mandatory, obtaining an ECOWAS identity card remains optional.

Furthermore, the NCRA will collaborate with the security sector to enforce compliance with the Cabinet Directive and Parliamentary Ratification, effective from 1st July 2024. This collaboration aims to ensure reliable identification of all residents, regardless of citizenship status, and to maintain consistency in their personal information.

It is important to note that the identification card bearing the unique National Identification Number (NIN) is legally recognized as the primary source of personal identification in Sierra Leone. Therefore, obtaining and carrying this identity card is imperative for all residents.

This extension follows a prior Public Notice issued by the National Civil Registration Authority in collaboration with the Sierra Leone Police and the Office of National Security on 5th February 2024, aiming to provide the public with ample opportunity to obtain their ID cards.

The National Identification Numbers (NINs) embedded in ID Cards are set to become a prerequisite for a variety of transactions and services, ranging from work and resident permit applications to accessing government provisions, obtaining driver’s licenses, and even eligibility for public examinations. Moreover, the NIN will be linked to land ownership and building permits, underscoring its significance in accessing essential services and rights.

To streamline the acquisition process, the National Civil Registration Authority (NCRA) has established multiple centers across Sierra Leone, where individuals aged 12 and above can apply for their National ID Cards. Non-citizens are also mandated to obtain Non-National ID Cards for resident and work permits. These centers provide Securitized Biometric Identity Cards, ensuring an efficient application procedure.

It’s worth noting that the introduction of ECOWAS compliant, internationally benchmarked Identity Cards has engendered a sense of pride among cardholders, while also unlocking seamless opportunities for accessing social services and government provisions. With the deadline fast approaching, the Government urges both citizens and non-citizens to act promptly to avoid last-minute rushes.

Parliamentary Committee Exposes Mining Companies’ Non-Compliance Issues

The Parliamentary Committee on Mines and Mineral Resources, led by Deputy Majority Leader 2, Hon. Saa Emerson Lamina, has shed light on non-compliance issues within certain mining companies operating in the country. During a visit to the Yankasa mining site operated by Commodity Trading Company (CTC) Mining Limited, the Committee learned of alleged hindrances to operations caused by Kingho Mining Company’s monopoly over the Pepel Rail and Ports.

CTC representatives claimed that Kingho’s control over these vital transportation facilities prevented them from exporting a significant quantity of mined bauxite, resulting in economic setbacks. The committee discovered a substantial pile of bauxite at the site, representing millions of dollars in lost production costs and expenses.

Additionally, in Lunsar, stakeholders accused Marampa Mines Limited of mismanagement of the Community Development Fund, specifically the allocation for the Community Development Committee (CDC) and administrative activities. Allegations were also made regarding mining companies in Kono District failing to pay the mandated 1% Community Development Agreement (CDA) to mining communities, potentially violating compliance policies.

The Committee’s oversight activities in Kono District revealed management crises at Seawright Mining Company and highlighted widespread absence of Mining Lease Agreements (MLAs) among mining companies.

To address these issues, the Committee issued several rulings:

Summoning Seawright Mining Company shareholders for a meeting with the Oversight Committee.

Requiring companies to obtain MLA in accordance with Sierra Leonean laws.
Requesting immediate updates on various CDAs from mining companies to support the Government’s Youth Employment Scheme.

Ensuring fairness and transparency in considering stakeholder positions, investor concerns, and state expectations.

Committee Chairman emphasized the Government’s commitment, under President Bio, to enhancing the mining sector and supporting host communities through initiatives such as the 1% profit on sales for CDAs and the 70% Surface Rent payment to landowners mandated by the Mines and Minerals Development Act of 2022.

Minister Turad Senesie Takes Decisive Action to Reclaim State Land in Kenema

In a demonstration of commitment to upholding the rule of law and safeguarding public land, Minister of Lands, Housing and Country Planning, Dr. Turad Senesie, led an inspection of the Kenema airstrip on Tuesday, April 2, 2024. Accompanied by key officials including the Director of Surveys, Tamba Dauda, and the Regional Director East, Dr. Senesie took decisive action against unauthorized construction activities on state-owned land.

According to accounts provided by the Minister, one Victor S. S. Ansumana ,arrived at the scene after receiving a distress call claiming that rather than cooperating the said Victor S. S. Ansumana confronted him aggressively demanding information about the disputed land.

Furthermore, the Lands Minister asserted that Ansumana’s behavior provoked disturbances among  certain misguided individuals which  resulted to a call for law enforcement to maintain order.

However, Ansumana, a Barrister and Solicitor,  has refuted the allegations stating that he was merely attempting to understand the situation involving his Clerk, whom he claimed was detained through the orders of Minister Senesie. He also stated that he and his companions were subjected to verbal abuse and physical assault by individuals associated with the Minister.

However, it was said that during the inspection, law enforcement officers, under the supervision of Dr. Senesie, apprehended a construction worker who had repeatedly ignored stop-work orders and requests for proper documentation. The suspect, claiming affiliation with a Magistrate, was found depositing materials on a disputed land without legal authorization.

Subsequently, the situation escalated when the lawyer, Victor S. S. Ansumana, arrived at the scene with a group of individuals and attempted to obstruct lawful enforcement actions. Despite aggressive behavior and demands for unconditional release, Dr. Senesie remained steadfast in ensuring compliance with regulations.

Following the altercation, Ansumana and several others, including his clerk and brother’s wife, were arrested on the basis of Senesie’s complaint. Senesie maintains that Ansumana’s actions constituted incitement and trespassing.

It was also stated that in response to attempts to disrupt proceedings, law enforcement officers intervened promptly, detaining individuals engaged in the riotous behavior and ensuring the safety of Dr. Senesie and his team. The Minister later reported the incident at the Kenema Police Station, emphasizing the importance of upholding the law and protecting public servants in the execution of their duties.

Contrary to misinformation circulating on social media, Dr. Senesie’s actions were rooted in the principles of accountability and transparency. His steadfast commitment to enforcing regulations and preserving public assets underscores his dedication to serving the interests of the people of Sierra Leone.
